Terms of Use
These terms are the agreement between you and Emberstead for using the app. We have kept them readable on purpose. By creating an account or using Emberstead, you accept them. If you do not, please do not use the app.
What Emberstead is
Emberstead is a shared family calendar for iOS, Android and the web. It is currently a beta, which means it is still being finished: features will change, some will be added, a few may be removed, and it will occasionally be unavailable while we work on it.
Who can use it
- Account holders must be 13 or older. If you are under 18, you need a parent or guardian's permission to agree to these terms.
- A parent or guardian sets up the household and adds cards for children. Younger children take part through those cards, not through accounts of their own.
- If you add someone else, including a child, you confirm you are entitled to share their details with the rest of your household, and you remain responsible for what you add about them.
Your account
- Give accurate sign up details and keep your password to yourself.
- You are responsible for what happens under your account. Tell us quickly if you think someone else is in it.
- One account per person. Do not share a login; invite people into your household instead.
Your content stays yours
You keep any ownership or other rights you have in the plans, names, photos and notes you add. We claim no ownership of them. You grant us only the permission needed to host, copy, process, transmit and display that content to run, secure and support the app, including syncing it to the devices in your household and maintaining backups. You must have the right to add and share content about somebody else. This permission ends when the content is deleted, apart from the time required for backups and legal or security obligations.
We do not use your content for advertising or to train anything. We access it only where needed to operate and secure the service, comply with law, or investigate a support request you have made.
Using it fairly
Please do not:
- break the law, or store or share content that is unlawful, harmful or infringes someone's rights;
- try to reach another household's data, or probe, scrape or overload the service;
- reverse engineer the app, except where the law expressly says you may;
- resell the service or pass it off as your own.
We may suspend or remove access that does these things. Where it is reasonable to do so, we will tell you why first.
What it costs
Emberstead is free during the beta, with no card required. If paid plans arrive later we will say so clearly and in advance, and the core family calendar will stay generous. You will never be charged without agreeing to it first.
Availability, and keeping your own copy
We work to keep the app running and your plans in sync, but in a beta we cannot promise it will always be available, always correct, or that nothing will ever be lost. Please do not make Emberstead the only record of something you cannot afford to lose.
No warranty
Emberstead is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. Some countries do not allow certain warranties to be excluded, so parts of this may not apply to you.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential losses, or for lost data or missed plans, arising from your use of the app. Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
If you got the app from Apple or Google
These terms are between you and us, not with Apple or Google. Those stores are not responsible for the app or for supporting it, and any claim about the app is ours to answer rather than theirs. Where Apple's own rules require it, Apple is a third party beneficiary of these terms and may enforce them. You also agree to comply with the store's own terms, and you confirm you are not in a country subject to relevant trade embargoes.
Ending it
You can stop using Emberstead and delete your account at any time from Settings, with no notice and no reason needed. We may suspend or end access if these terms are broken, or if we stop offering the service, in which case we will give you reasonable notice and a way to get your data out. When you delete your account, your data is removed as set out in the Privacy Policy.
Changes to these terms
We may update these terms as the app grows. We will change the date at the top and, for anything meaningful, tell you in the app before it takes effect. If you carry on using Emberstead after that, you accept the updated terms; if you would rather not, you can delete your account.
Law and disputes
These terms are governed by the law of the country named in the note below, and disputes go to that country's courts. If you are a consumer, none of this takes away the rights or the local courts your own country's law gives you.
